Agreement to Terms

By downloading, installing, or using Impello ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.

Description of Service

Impello is a fitness tracking application that allows you to:

  • Log and track your workout sessions
  • Monitor your progress over time
  • Sync workout data with Apple Watch and across your devices
  • Access historical workout data and analytics

User Accounts

To access certain features of the App, you may need to create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account

You must be at least 13 years old to create an account and use the App.

Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of these Terms
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the integrity or performance of the App
  • Reverse engineer, decompile, or disassemble any part of the App
  • Use the App to transmit any harmful code or malware
  • Impersonate any person or entity or misrepresent your affiliation

Intellectual Property

The App and its original content, features, and functionality are owned by Impello and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any workout data you create within the App. By using the App, you grant us a license to use, store, and process your data solely for the purpose of providing and improving our services.

Subscriptions & Payments

Some features of the App may require a paid subscription. Subscription terms include:

  • Subscriptions are billed in advance on a recurring basis (monthly or annually)
  • Payment is processed through Apple's App Store payment system
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
  • You can manage or cancel your subscription through your App Store account settings

Health Disclaimer

The App is designed to help you track your workouts and is not intended to provide medical advice. Always consult with a qualified healthcare provider before starting any new exercise program. We are not responsible for any injuries that may occur from exercise programs you perform while using the App.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IMPELLO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

You may delete your account at any time through the App settings. Upon account deletion, we will delete your personal data in accordance with our Privacy Policy.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes through the App or via email. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Impello is incorporated, without regard to its conflict of law provisions.
